What is Mediation?

Mediation is highly personal and confidential: a professional interactive process designed to resolve disputes between people who cannot resolve the dispute themselves. There are many kinds of disputes, so the nature of mediations can be quite different. Mediation requires the parties to actively participate and try to work it out themselves with the aid of and facilitated by a trained and neutral professional mediator.

The Mediator is a qualified and accredited independent third party whose role is to create a safe, professional and confidential environment to facilitate communications for people to talk to each other. The Mediator enables communication through carefully structured processes using techniques. The outcome of discussions in mediation is dependent on the willingness and ability of the people involved to participate in negotiations with each other. The Mediator guides the discussion, ensuring it remains positive and stays on track and that the people present in the mediation are respectful to each other, with all parties on a journey to find out if they can reach an agreement that everyone is happy about.

There are specialist Mediators for specialist topics, and generalist Mediators who can facilitate general discussions and negotiations around most topics. The best thing about mediation is that the Mediator structures the process around the parties’ needs.

I offer general mediations for many differing kinds of disputes. I also provide family mediations (which requires specialist qualifications in Australia to help couples with parenting and family property – see the Family Mediation tab in the Menu above). I expect people to give it their best shot and to attempt to negotiate respectfully. Their mediation is more likely to produce an agreement they are happy with it and can live with their own decisions into the future. If they are honest and respectful towards each other it may even change the way they interact in the future.

Sometimes when there is conflict emotions can flare, and it is more likely that people will settle down with a secure and safe environment that gives them the opportunity to learn how to talk to each other respectfully. Mediation is a professional and confidential setting which will provide people with a safe environment to do this, to just express themselves. This feeling of being comfortable can sometimes help people think creatively and move on from disagreements.
